پیاده سازی چهارچوب استاندارد مدیریت دعاوی در پروژه های سدلاستیکی با قراردادهای فهرست بهایی

چکیده

مدلسازی سد لاستیکی، تکنولوژی نسبتاً جدیدی است که سابقه استفاده از آن به حدود 60 سال قبل می رسد. با توجه به اینکه مدت زمان زیادی از ورود این تکنولوژی به کشور نگذشته است، شناخت کافی از ابعاد آن چه در بخش تهیه و تنظیم قرار داد و چه در بخش اجرا وجود نداشته و اغلب پروژه های جاری متأثر از اختلافات متعدد فی مابین پیمانکار، مشاور و کارفرما بوده و با تاخیر در زمان اتمام و افزایش هزینه های ساخت همراه گردیده است. در این پژوهش، نخست نسبت به شناسایی عوامل موثر در بروز ادعا در پروژه های سد لاستیکی اقدام گردیده و سپس با تهیه و توزیع پرسشنامه و مصاحبه با متخصصین شاغل در پروژه های سد لاستیکی نسبت به اولویت بندی عوامل موثر در بروز ادعا در پروژه های سد لاستیکی اقدام گردید. در مرحله بعد با مراجعه به قوانین و مقررات موجود، شرایط خصوصی قرارداد های جاری و همچنین نتایج جلسات متعدد مدیریت ادعای برگزار شده در پروژه های مختلف، راهکار مناسب براساس اولویت بندی انجام شده تهیه و با اخذ تائید 5 نفر از متخصصین امر اصلاح و ارائه گردید. نتایج پژوهش نشان می دهد که راهکارهای منجر به پیشگیری از وقوع دعاوی با 80.62% به نسبت راهکارهای ارائه شده به منظور توافق با 19.38% از مطلوبیت بیشتری برخوردار است.

چکیده [English]

Rubber dam in construction projects is a relatively new technology, whose history of usage goes back to about 60 years ago. Considering the short period of presence of this technology in Iran, there is not enough knowledge of its dimensions, These projects have a different contract. whether in the section of contract preparation and arrangement or in the execution section. Therefore, majority of the current projects are affected by numerous disputes between the contractor, the consultant and the employer and these projects are accompanied by delay in completion time and increase in construction costs. In this study, first, the effective factors in claiming were identified and then prioritized by preparing and distributing questionnaires and collecting the opinions of experts, who work in rubber dam projects. In the next step by referring to the existing laws and regulations, private terms of current contracts as well as the results of numerous meetings of claim management which were held in various projects, a proper strategy was proposed based on the suggested priority. This strategy was finally modified and presented after confirmation of five experts. Finally, it was concluded that the approaches that led to the prevention with 80.62 percentages were more favorable than the agreement strategies with19.38 percentages.
